Terms of Service

These Terms of Service ("Terms") are an agreement between you and Scott John Mathews trading as Space Cake of 31 Holcroft Drive, Wigan, WN2 5YP, United Kingdom ("Space Cake", "we", "us"), governing your access to and use of the Space Cake service at spacecake.one (the "Service"). By creating an account or using the Service, you agree to these Terms.

1. The Service

Space Cake connects to email inboxes you authorise and uses automated processing to read incoming messages, classify them, and draft replies. You decide whether drafts are sent manually or automatically. The Service is provided on a subscription basis.

2. Your account

You must provide accurate information and keep your login credentials secure. You are responsible for activity under your account and for any team members you invite. You must be at least 18 and authorised to act for the business you register.

3. Acceptable use

You agree not to use the Service to:

• send unlawful, abusive, deceptive, or unsolicited bulk messages;
• infringe others’ rights or violate applicable law, including marketing and privacy law;
• attempt to disrupt, reverse-engineer, or gain unauthorised access to the Service.

You are responsible for the content of messages sent from your inboxes, including replies you approve or enable to be auto-sent.

4. Fees, trials, and billing

Paid plans are billed in advance on a recurring basis at the prices shown on our pricing page. Plans begin with a free trial; you will not be charged during the trial if you cancel before it ends. You can cancel at any time, effective at the end of the current billing period. Except where required by law, fees already paid are non-refundable.

5. Your content and data

You retain ownership of your data and the content of your inboxes. You grant us a limited licence to process that content solely to provide the Service to you. Our handling of personal data is described in our Privacy Policy and, where applicable, our Data Processing Agreement.

6. Availability and changes

We aim to keep the Service available but do not guarantee uninterrupted operation. We may update, suspend, or discontinue features, and will give reasonable notice of material adverse changes where practicable.

7. Disclaimers

Automated drafting may produce errors. The Service is provided "as is" and "as available", without warranties of any kind to the extent permitted by law. You are responsible for reviewing automated output and for messages sent from your account.

8. Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect or consequential loss, or loss of profits, revenue, goodwill, or data. Our total liability arising out of or relating to the Service in any 12-month period is limited to the fees you paid us in that period. Nothing in these Terms limits liability that cannot be limited by law.

9. Termination

You may stop using the Service and cancel at any time. We may suspend or terminate access if you breach these Terms. On termination, your right to use the Service ends; you may export your data beforehand as described in the Service.

10. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, unless mandatory local law provides otherwise.
